Peratović Željko, because of pressures and heckling comments on political meetings, on street, in trams, that he is betrayer of Gotovina and British spy, experienced psychical shocks, discomfort, harassing, threats, humiliation. In daily newspapers, March 2004., there were published the informations that at that time, chief of POA (Counter-Intelligence Agency), Franjo Turek, collected and presented to the top of the state of Croatia, evidences about hostile activity of the journalist of daily newspaper Vjesnik, Željko Peratović, weekly magazine Globus, Gordan Malić, weekly magazine Feral Tribune, Ivica Djikic and daily newspaper Novi list, Boris Pavelić. About the fact that he was on POA’s list of journalists who were suspected of publishing disinformations about habitation of deserted general Ante Gotovina, and in cooperation with main ICTY’s prosecutor, Carla Del Ponte, with foreign spies, domestic intelligence underground and former chief of MUP, Ranko Ostojić, Željko Peratović was informed by telephone conversation with journalist Ivica Đikic, adding that the information was confirmed to him by President of management of weekly magazine Nacional, Ivo Pukanić.
Because of discomposure and fear that the informations would damage his social and professional reputation, and possible physical endangerment, Boris Pavelić and Željko Peratović gave on 18.03.2005. memorandum to the Council for civilian control of safety services within Croatian Parliament. (attachment 1)

Željko Peratović has cognitions that he is under secret control of POA (Counter-Intelligence Agency). Not only his professional contacted are under control, but his family is also included, his wife and her father, mother and sister, who live in Switzerland, and also his brother in Zagreb.

In time of delivering the first Memorandum to Council for civilian supervision of safety services, Željko Peratović was warned by Mrs Dijana Pajagić, person who were in very friendly relations with Željko Bagić, former advisor of President Stjepan Mesić for national security, and other persons from circle of so called, helpers of general Ante Gotovina, that Peratović shouldn’t get himself into finding out the truth about Presentation of former chief of POA, Franjo Turek, because for him «it would be dangerous, and you have little baby. Željko Peratović understood that seriously as a threat on physical safety of his family and himself. That threat he described in his second Memorandum to Council for civilian supervision of safety services. (attachment 2)

Answer of Council on the first Memorandum of Željko Peratović, which he signed with Boris Pavelić, was that POA gave to the Council statement in which was said that they were not under surveillance of POA, and that POA didn’t supervised journalists generally. Even after that reply, Peratovic was getting indications that he was under surveillance of POA, and that Franjo Turek accused him for being enemy.

The main editor of Vjesnik said to Peratović that Karamarko didn’t have summerhouse on Mljet and that was untruth, the same thing was if she wrote that Peratovic was murder. She also added that agains Peratović protested Mate Bašić from Australia. She warned that she decided to go for a lunch with Tomislav Karamarko, to try to prevent Karamarko from filing charges against «Vjesnik». After few days, Andrea Latinović informed Peratović publicly in editorial office that she went for a lunch with Tomislav Karamarko and they talked for five hours about Peratović and that Karamarko said a lot of things about Peratović.
Tomislav Karamarko is professional policeman and intelligence agent (he was chief of Zagreb’s police, superintendent of UNS (National Security Office), and now he is chief of POA – Counter-Intelligence Agency). Peratović met him only once in 1998. in restaurant owned by Zvonimir Trusić, on Blato – Remetinec. Because of those facts, Peratović categorically claims that Tomislav Karamarko was talking to Andrea Latinović about his professional cognitions about the journalist, what he shouldn’t do, regardless of accuracy of the informations, because that was prohibited to him by Law of protection of informations and Law of security services. That had disagreeably consequences for Peratović.

Editorial office of Vjesnik more rarely published texts of Željko Peratović, even under censorship were those texts which was ordered by editorship. The explanation why his texts were not published he didn’t get, except once editor of internal politics, Marijana Matković for text about Damir Jukica, one of onetime highly positioned functionaries of POA, who in interview for weekly magazine Nacional (attachment 3.1) confirmed presenting of Presentation of chief of POA, Franjo Turek, to the top of the state about hostile activity of journalists, said that text wasn’t published because it was based on compilation of somebody else’s texts and it was full of incorrectnesses. That explanation she filled up with remarks that in his texts could never be seen the source. That was repeated to Peratović on meeting in January 2005. with main editor Andrea Latinović, her deputy, Marijana Matković and assistant of main editor, Zoran Vodopija.

Considering that identical evaluation about writing of this journalist is in Information of former chief of POA since 16.10.2004. (attachment 3), Peratović claims that editorship of Vjesnik was illegally informed with opinion of POA about his way of working. That statement is supported by evaluation that till the end of 2004. Peratovic extremely professionally cooperated with Zoran Vodopija, Marijana Mikašinović and Marijana Matković, and that they have never put against him the way of his writing and his themes, on the contrary, they gave him their support.

In autumn 2004., after the text about possible helpers of deserted Gotovina, and in which was emphasized that one of them was Ante Žoni Maksan, who often advertising in medias his security firm, Peratović got a phone call in editorial office of Vjesnik from Robert Valdec, journalist who cooperated closely with Maksan. The conversation was very short and Peratović only understood that Valdec called him, with message that he was in some cafe′ with some friend and the line disconnected. The next day in Zagreb on crossroads of Savska cesta and Slavonska avenija he accidentally met with Munib Suljić, who said through opened window of the car to Peratović: Where are you, pig!?
Munib Suljić was sentenced to prison for five months because of physical threats to Peratović. As Munib Suljić, except for attack on Peratović in 1999, in public was mentioned as a participator in murder of family Zec, and as he was one of accused on current trial on County court in Zagreb for events in Pakračka poljana in 1991, Peratovic was very scared. (attachment 2).
After several days, Peratović was informed by a colleague in Vjesnik, Marin Dešković, that Robert Valdec wanted to engage Munib Suljić to sort things out with Peratović, but at the end Suljic gave up that plan. That information was confirmed to Peratović by Anri Paravić, editor in section Black chronicle in Jutarnji list, who said that he was sitting at the table with Valdec and Suljic when Valdec was persuading Suljić to beat up Peratović. Paravić said to Peratović that he was protecting him and that he was talking out Valdec and Suljić from that plan, in which he succeeded in 4:00 in the morning, when they split up.

Peratović with this event informed the main editor of Vjesnik, Andrea Latinović, who thought those were privat things between Peratović and Valdec, what was’t the truth, what so ever, because Peratović was the journalist in Vjesnik. The main editor, didn’t not only protect Peratović as a journalist in Vjesnik, but she immediately engaged Valdec in cooperation with editorship of Vjesnik, confiding him, among other things, writing on theme which till then was Peratović’s job: safety services.

Meanwhile, the most texts on theme of informations from disputable Presentation, was published in weekly magazine Nacional (attachment 3.2). Inspired by work of POA, in Nacional Peratović was accused for spreading disinformations even in Serbia about Gotovina (attachment 4), and the text about 600 appears of general Gotovina was published, in which was said that exactly Peratović has published the most wrong informations about Gotovina’s residence (attachment 5).

Weekly magazine Nacional didn’t publish Peratovic’s official denials, and editorship of Vjesnik didn’t let him to give official denials in newspapers for which he has worked.

In November 2004, Peratović was guest in HTV’s program, Otvoreno on theme the Helena Puljiz case. After the program, Zeljko Bagic, mentioned advisor of Croatia’s President, accused Željko Peratović, in front of political analyst, Davor Gjenero, and present advisor of Croatia’s President for defense, Vlatko Cvrtila, that he from British (British secret service M16) for getting money for placing disinformations about Gotovina and that he mostly «worked» with Dragutin Frančiškovic.

One week later, Bagić was on HTV’s program Nedjeljom u dva, where he said that Franjo Turek held the presentation for President Stjepan Mesić, Premier Ivo Sanader, Minister of justice Vesna Škare Ožbolt and Minister of police Marijan Mlinarić, and that to the top of the state was presented cooperation of journalists with foreign spy. Bagic’s appearance urged Peratović to proceed, to the Council for civilian supervision of safety services, second Memorandum of citizens and two additions.(attachment 2)
He asked for another investigation of POA’s use of secret measures of surveillance over him, proclaiming the content of presentation, he was bringing out the concern for existence of his family and himself because of continuation of spreading imputations and slanders that he was foreign spy in service against Croatian hero general Ante Gotovina.

In one of additions is said that in January 2005. daily newspaper from USA, Washington Times, in its Internet issue, gave text in which Peratović was proclaimed for agent of British secret service MI6 in Gotovina case (attachment 2). That newspaper, a foothold for conceived lie about Peratovic’s cooperation with British secret service, absorbed from Franjo Turek’s Presentation, and also was said that President Stjepan Mesić revealed Peratović’s spy role. This text brought great damage to Peratović’s international reputation, especially because many professional pages passed it over, which was dealing with national security or journalism.

Željko Peratovic is a winner of international award- Press Freedom Award – Sign for Europe 2003, Austrian branch of prominent journalist organisation Reporters without borders. In explanation of award is emphasized Peratović’s contribution in opening debate in Croatian society about war crimes done by Croatian forces in Croatian War of independence.

Even before international public was familiar with his work and threats from secret services and persons connected with war crimes. After the advisor in HIS – Croatian Intelligence Service in 1998, Josip Perković, threatened him with a gun and after Munib Suljić physically attacked him in 1999, in Peratovic’s protection stood International federation of journalists (IFJ), turning to, at that time, President of Croatia, dr. Franjo Tuđman, Premier Zlatko Mateša and Minister of police, Ivan Penić, to give protection to the journalist. (attachment 6)

Željko Peratović are called by foreign journalists, not rarely, on themes of war crimes, organized crime and manipulation with secret services on area of South-east Europe, and after the text in Washington Times, his international contacts have become less frequent. When he asks for an information from international sources, not rarely, he gets distrust and often he has to explain that he is not M16’s spy. This is huge and inestimable damage for journalist Željko Peratović, considering that his international reputation is damaged.

Marijo Kavain said to Zeljko Peratovic that journalists in Northern Ireland were inquiring how was Peratović a journalist and a spy of British intelligence service MI6, and that sympathizers of Irish separatist movements spoke nasty about Peratovic. In text in Washington Times was said that Peratovic had bad opinion about general Gotovina and his connections with IRA. As a main motive which moved Peratović against Gotovina was mentioned alleged belief that Gotovina was involved in murder of the journalist’s friend, Milan Levar. The text in Washington Times was also on international Internet forums, and translation was published on all Croatian Internet forums with comments of members of debate that Peratovic was betrayer and that he spied for foreigners against general Gotovina. This is a fatal attack on person and work of journalist Željko Peratović. By all means he is tried to be prevented from writing the truth. In international standards his physical safety is also endangered. He is afraid of traveling to Great Britain because he could be attacked by sympathizers of Irish movement for separation.

Peratović feels constant danger because of his writings. After the murder of Milan Levar, Croatian Journalist Association asked from police to take care of safety in adequate way of our member, journalist of weekly magazine Fokus, Željko Peratović, who wrote several times about events in Gospić and was the last journalist who talked to Levar on the day of murder. (attachment 6.1)

To Željko Peratović by e-mail was from Office of Commissioner of EU for enlargement, Mr Olli Rehn, informed that they were following progress of that case, and that every country which candidate for membership in EU must knew that freedom of speech was one of the first basic freedoms, which must be followed in it, if it wanted to get into EU. (attachment 7). By that was given to Peratović cognition that his case was examining in frame of filling AVIS, which EU gave to Croatia – chapter freedom of media.

In February 2005. weekly magazine Globus published a text under title Turek’s presentation in which journalist Gordan Malić brought copies of disputable Presentation (attachment 8). In text in weekly magazine Globus, Peratović was mentioned twice, as followed:
1) «By informations from the «Presentation», Turek «discovered» two groups which continuously make facts false about «Gotovina case». In first group is chief of police, Ranko Ostojić and journalist of Globus, Gordan Malić, with contacts in international circles, in ICTY, in SFOR, USA embassy and British embassy. The task of first group is presenting inability of Croatian intelligence services in arresting Gotovina, and convince international public that Gotovina is in Croatia. To the group belong journalists: Davor Butković and Ivica Đikić. In second group are retired intelligence agents: Dragutin Frančišković, Božo Kovačević, Ljubo Ljubišić, Darko Starčević, who the informations about alleged residence of general Gotovina in Croatia, passing to investigators of ICTY, to chief of police, Ranko Ostojić and to journalist of Vjesnik, Željko Peratović.
2) «Besides Malić, Đikić and Butković, Franjo Turek ordered the treatment of journalist Marijo Kavain and Ivanka Toma from Jutarnji list, journalist from Vjesnik, Željko Peratović and journalist Boris Pavelić from Rijeka’s Novi list. Most of informations for analysis of newspapers, Turek got out of lists of phone calls of Croatian journalists. Such datas, about calls and conversations, Turek very freely interpreted, according to different theories of conspiracy. Turek, as it was claimed in Presentation, thought that those suspicious journalist activities were going on consciously, organized, coordinated and planned. The conclusion was: «Named activities has a goal: to discredit the institutions of Croatia, to create pressures on Croatia and make harder and slower approaching of Croatia to EU.»
Journalists Gordan Malić, Ivica Đikić, Marijo Kavain, Ivanka Toma and Željko Peratovic together asked from Council for civilian supervision of secret services and Committee for internal politics and national security, to investigate quotations from Globus’s text, among others, were they in 2003. and 2004. under secret surveillance of POA, and that authorized state institutions, and also the Government, whose three members: Premier Ivo Sanader, Minister Vesna Škare Ožbolt and Minister Marijan Mlinarić, were present on Presentation, give their opinion about imputations of Franjo Turek, that mentioned journalists discredit Croatia with conceived, organized and coordinated placing of disinformations about residence of general Gotovina. (attachment 9)
The support for their demands they got from prominent international associations: Committee To Protect Journalists from New York (attachment 10), International Press Institute from Vienna (attachment 11), Human Right House from Oslo (attachment 11). That case entered even in international annual reports about condition of freedom of medias in the world, with estimations that highly positioned state functionaries obstructed cooperation with International crime trial for ex Yugoslavia and claimed journalists for foreign spies (attachment 12).

Namely, by quotations of Franjo Turek, Peratović and Pavelić are in the group of journalists who are, by estimation of POA, feeded Croatian public with disinformations, in favour of secret services, so called intelligence underground, in way that they were spreading untruth about residence of general Gotovina in Croatia. Željko Peratović has indirect cognitions that he is under secret tracking and surveillance. Not only his professional contacts are being controlled but also his family, wife and her mother, who lives in Switzerland, and also his brother in Zagreb. Željko Peratović has not fed Croatian public in favor of secret service, so called intelligence underground, and he hasn’t spread untruth about residence of general Gotovina in Croatia. The journalists in Memorandum asked to be find out whether such files about them existed and who gave authorization for their surveillance and tracking and on which legal basis. They also asked answer on the question: what was in those files, who had approach to it and what about their further destiny.

Ivan Jarnjak, President of Committee for internal politics and national safety, gave to Željko Peratović the report about POA’s work in connection with Memorandum of the group of journalists, with notice that Working group of Committee for internal politics and national safety and Council for supervision of safety services did the controlling in Counterintelligence agency. In report is said, among other things: «By insight in lists of files of secret collecting of datas and in whole documentation of operative action it is established that POA in 2004. didn’t use measures of secret collecting of datas of the journalists – submitters of Memorandum, and that in concrete operative action registrated only contacts of Gordan Malic for safety of interesting persons. So there is justified suspicion that by pointing out submitters of Memorandum (Gordan Malić, Ivica Đikic, Ivanka Toma, Željko Peratović and Marijo Kavain) in «PRESENTATION» without no reason violated their human rights and basic freedom guaranteed by Constitution (article 38, paragraph 1,2 and 3, of Constitution of Croatia) because from the collected informations can’t be justified the operative title and thesis given in «Information about intelligence-media manipulations, with goal of discreditation of Croatia» and that named journalists, in that sense, participated in actions which would endangered national security.»
Franjo Turek is Croatian functionary and he on detriment of Željko Peratović was breaking the Law of safety services of Croatia, in way that he, without arguments, continuously was presenting him as a person who worked against national interests of Croatia. Turek Franjo was using measures of secret collecting of datas, that was, controlled communications of Željko Peratović surelly in 2003. and of which had damages Dragutin Frančišković and Mario Barišić.
Present chief of POA, Tomislav Karamarko, is responsible for measures of POA, under which was Peratović since November 2004. till today (opening the letter to Furio Radin etc.), by the article 63., of Law of safety services, for damage done to citizens, by illegal, intentionally or extremely uncareful action of employee of safety service, responsible is Republic Croatia.
The consequences for Peratović Željko are disastrous on economic, professional and moral base, but also medical. That kind of acting of POA, by the proposer, is stressful condition and inhibits it in original analysis and critical approaches of considered problems which are happening in society. He has the feeling of constant threat and editorial aversion from confiding journalist investigation work, what is for individual journalist, for profession, and also for public, fatal. That has a great influence on his professional behavior. In question are the freedom and professional work of journalist. No matter the Committee for internal politics and national safety brought mentioned conclusion, journalist rights of Željko Peratović are still violated, because in newspapers he is working for, Vjesnik, and which are formally owned by the Government of Croatia, is not allowed writing about themes he wrote before: intelligence services, organized crime and war crimes. Almost any writing is prohibited.
The Committee for internal politics and national safety says that over Peratović POA didn’t use measures of secret collecting of datas in 2004. Nevertheless, Committee for internal politics and national safety and Council for supervision of safety services didn’t reply on question from mutual Memorandum, whether over five journalists are used measures of secret collecting of datas in 2003. As the control of mail deliveries also is in measures of secret collecting of datas, and Peratović thinks that POA opened the letter to Committee for human rights and rights of national minorities, sent at the end of las year, so in that way his right of privacy of communication is violated.
To that Committee Peratović sent Information about background of some newspapers’ titles about Gotovina case, dated 16.10. 2003. , and signed by former chief of POA, Franjo Turek, in which is analyzed one his text about possible movement of deserted general Gotovina. So, before «Presentation» to the top of the state, which was investigated by Committee for internal politics and national safety, POA described Peratovic’s writings as result of influence of domestic intelligence underground and International crime trial in Haag, whose motives were disruption of internal stability of Croatia, and its international reputation, so, endanger of national security. Information ends with notice to users: President of Croatia, Stjepan Mesić, secretary of President’s Office, Željko Bagić, President’s advisor for national security, Imra Agotić, Premier Ivica Račan, member of government, Goran Granić, main state attorney, Mladen Bajić and President of Parliamentary Committee for internal politics and national security, Ante Markov, that are: «That actions and influences of all groups, the subject of further research of POA», and that named ones about collected informations, will be regularly informed. Exactly these moments confirm that Peratovic was in 2003. subject of Operative investigation of POA, what would , besides the measures of secret collecting of datas, include datas from citizens and insight in registers and data collections.

As some persons with whom Peratović directly or by phone communicated, were under pressure (Dragutin Frančišković was publicly marked as chief of intelligence underground, which disinform Carla Del Ponte about Gotovina, and to Mario Barišić from Sibenik were sent threats with death), Peratović claims that POA by measures of secret collecting of datas surveillance his communication with mentioned persons. Further, datas which POA gathered about Peratović, and for which collecting don’t need approval of Supreme court, but only decision of chief of POA: conversations with citizens, insights in registers and data collections, were put in Peratović’s files (collections and registers of personal datas and other records of collected datas and documents with informations, article 22.paragraph 1. of Safety services law).

Article 23. paragraph 1. of the same Law says that services (POA) must, on request of citizen inform him whether over him are taken measures of collecting of informations, and if in services are records about his personal datas and on his request give him insight in documents about collected informations. Zeljko Peratovic was asking for datas through Council for civilian supervision of safety services, Committee for internal politics and national safety, public attorney of Croatia, but till today he didn’t get any answers. Željko Peratović categorically claims that datas and documents which are collected about him by «operative research and processing of POA» are misusing and that are not destroyed, as it says in article 24. paragraph 1., 2. and 3. of Secret services Law
XXVI
On described way are violated personal and political freedom and rights of Željko Peratović.
In article 38. of Constitution of Croatia are guaranteed freedom of thought and expressing of thoughts. The freedom of expressing thoughts includes especially freedom of press and other means of informing, right of speech and public appearance.
Censorship is forbbiden. Journalists have right on freedom of informing and access to information. To Zeljko Peratovic are violated Constitutional and rights by Law.
By article 1. of Law of medias guaranteed is freedom of expressing and freedom of medias. The freedom of medias especially includes: freedom of expressing of thoughts, independency of medias, freedom of collecting, research, publishing and spreading informations in order to inform public: openess of medias for different opinions, beliefs and for different cases.
In article 4. of Law of medias is said «Nobody has right by force nof misuse of function influence on program contents of media, or in any other way illegally limit the freedom of medias.». About violations of freedom of expression and freedom of medias decides court.
And by article 27, of Law of medias, journalist has right to express opinion about all events, phenomenons, persons, things and professions.
International convention about protection of human rights and basic freedom, and which was accepted by Croatia in 1997., is considered as a part of legal system of Croatia. By article 1. of that convention everybody has right on freedom of expression. That includes freedom of thoughts and freedom of gathering and spreading informations and ideas without interference of public government and no matter the borders.
Even the Government of Croatia gave firm belief that freedom of medias and speech one of basis of democratic society in which nobody is allowed and can’t interfere.
POA with other factors directly interfered in writing of texts of Željko Peratović, and in order to disable him and prevent him in freedom of expression and right of informing public.
And to conclude: Željko Peratović is imputing that he is a spy and that he is enemy of Republic of Croatia, only because he as a journalist acted professionally, holding to principle of truth, and rules of profession, and secret services and other factors were preventing him from telling the truth, free opinion, and spreading true informations, what is confirmed by quoted conclusion of Committee for internal politics and national safety.
Because all mentioned, proposer Peratović Željko has legal interest to demand compensation of damage from Republic of Croatia because he was illegally observed by POA (Counterintelligence – Agency).
Proposer specify his indemnity requirement as follows:
a) on the name of compensation of nonmaterial damage because of endured fear demands amount of 400.000,00 kn;
b) on name of compensation of nonmaterial damage because of endangering of freedoms 500.000,00 kn;
c) on name of compensation of nonmaterial damage because of violation of honor and reputation 300.000,00 kn;
Besides mentioned Željko Peratović asks to make possible for him to have insight in his personal collection of personal datas (file) in POA, that he can in the future freely candidate for sate jobs in which safety check is needed. If State attorney’s office wouldn’t accept agreement out of court based on these facts and attached evidences, proposer will file charges to authorized court against Croatia, for compensation of damage. Because of establishing the basis of all proposer’s claims, proposer suggests to be done insight in attached documentation and to hear all suggested witnesses:
